Broad Areas Of Criminal Defense Representation
Experience Matters.
My name is Cary L. Lackey, Esq., I am a criminal defense attorney in Phoenix, Arizona with over 21-years of legal experience. I aggressively defend individuals in both state and federal court charged with felonies and misdemeanors. I am licensed to practice law in ALL Courts in Arizona. The areas I practice in include:
- DUI/DWI
- Criminal traffic tickets and offenses
- Drug charges, including possession, transportation, and sales

- Felony and misdemeanor assault
- Vehicular homicide and assault
- Shoplifting
- White collar crimes
- Immigration consequences of criminal convictions
- Juvenile crimes
- Probation violations
To effectively practice criminal law, one needs to adapt to a large number of circumstances. Every arrest is different and requires individual handling. To speak to me, and NOT an associate or paralegal, about your unique situation, call The Law Office of Cary L. Lackey, P.C., at 602-288-2303 for a free initial consultation.
Areas of Practice
DUI/DWI
In Arizona, the penalties for drinking and driving are severe and go far beyond criminal penalties such as fines and imprisonment. There are also a number of administrative ramifications with DUI/DWI charges that occur pertaining to driver's licenses/driving privileges. I will fight for your right to hold onto your driver's license as well as defend you against criminal charges.
DOMESTIC VIOLENCE/VIOLENT CRIMES
Domestic violence charges such as assault, disorderly conduct, and/or criminal damage can destroy you and your family. When charged with such crime(s), you need a knowledgeable and skilled criminal defense attorney who will handle your matter from beginning to end.
Traffic violations
Though traffic offenses are not the first thing that come to mind when speaking of criminal defense, these offenses can often have severe consequences. Certain DUI offenses result in felony charges. Other traffic offenses like reckless driving, driving on a suspended license or hit-and-run offenses can result in similar, serious consequences — especially in the event someone else is injured, or property is damaged.
JUVENILE CRIMES
Young people make mistakes. They're often dealing with issues that they are not prepared to face, and sometimes they act out inappropriately. A fight with a parent, brother, sister, other family member, or a student at school may result in assault or other related charges. As a juvenile criminal defense lawyer, I approach every case differently because the needs of each youth are never identical. I look for the sort of resolution that will best remedy the young person's situation, which will place him or her on the right path towards a better future.
DRUG CHARGES
A greater amount and variety of drug charge filing in state and federal courts are occurring than in years past. Besides drug possession or drug sales involving marijuana or illegal narcotics, drug charges involving prescription medications are on the rise. Conspiracy to distribute, transfer and/or sell drugs across state line charges often result in a federal case with extremely harsh penalties possible.
COLlege crimes
Though young adults may be independent college students not living at home, they haven't yet reached the status of fully independent adults. Meant to be a time for learning, college is also a time when many young adults face exposure to drinking, drug use, and college hazing. Sometimes, relationship issues arise, which may lead to allegations of domestic violence. These matters often lead these students to the first exposure they will ever have to the criminal justice system. These students not only face jail time, probation, and fines from the court, but they may also face discipline, including expulsion, from their college. It's for this reason that such students require the most knowledgeable and experienced lawyer to defend them.
WHITE COLLAR CRIMES
I provide white collar crime defense representation, to individuals and/or businesses, on a wide variety of criminal, civil, and/or administrative violations. Often, even just the allegation of a white collar crime can destroy the accused's professional and personal reputation. Convictions for fraud, theft, and/or other felonies, may prevent the accused from ever working in certain professions again.
I have extensive experience representing professionals before their respective, administrative licensing boards, usually done in connection with, or as a result of, criminal charges brought in city, state, or federal courts.
IMMIGRATION LAW
If you are not a U.S. Citizen and you have been accused of a crime in Arizona, you could have a lot to lose. Convictions and guilty pleas for certain offenses can lead to months of detention with a deportation (ICE) hold, and even removal or deportation to your home country. A criminal conviction can also prevent you from ever becoming a U.S. Citizen.
If immigration issues are a part of your criminal defense case, it is critical to work with an attorney who understands the relationship between criminal law and immigration. I use more than 20+ years of experience to help my criminal defense clients achieve the best possible results. I have experience in state courts throughout Arizona, as well as federal immigration courts. I understand the concerns of immigrants.
PROBATION VIOLATIONS
Probation matters in Arizona can be extremely tricky – especially if the accused is charged with a new offense when he or she is already on probation. Miscommunication between the accused and their assigned probation officer(s) can often arise and the consequences are great.
The time frame for responding to an alleged probation violation is short. I make myself available and take immediate action on any petition to violate probation filed, to ensure that deadlines are met. Having represented so many individuals in criminal defense matters, I have a good working relationship with judges, prosecutors, other lawyers, as well as probation officers throughout Maricopa, Pinal, and Gila Counties.
