First-Offense DUI

The penalties for even the first DUI/DWI arrest and conviction in Arizona can vary widely. The severity of the penalties is largely dependent upon blood alcohol measurements. Reduction of penalties can occur when alcohol and/or drug evaluations are completed and there is a willingness to submit to treatment. The level of fines, surcharges and assessments will also vary depending upon the BAC level. There are also issues of personal embarrassment and damage to your personal and professional relationships that exists following the first DUI arrest.

Because the outcome can vary so greatly, every first DUI arrest requires individual handling. The outcome of these matters is dependent on the unique circumstances of an arrest, the manner in which field sobriety or Breathalyzer tests took place, and whether there was actually probable cause to pull you over, etc. As a DUI defense attorney, I will comb through all evidence and testimony to find the means to, ideally, either reduce the charges or have the DUI charges dismissed.

Experienced Maricopa County DUI/DWI Lawyer

Long before I opened The Law Office of Cary L. Lackey, P.C., I had been defending individuals charged in DUI/DWI matters. Experience in this area is particularly important because there are many aspects to this area of law — some administrative aspects, and some related to the criminal case itself. I have seen many individuals convicted for DUI who could have avoided the harsh consequences if they had first spoken to an experienced criminal defense attorney. You need someone who understands the science that goes into DUI/DWI matters, who knows how to negotiate with prosecuting attorneys and who is comfortable with trying these matters in court.

It is the prosecution that has the burden of proving beyond a reasonable doubt that a DUI offense occurred. If arrested for a DUI/DWI, prompt action is required. The time for requesting administrative hearings is short — 15 days from the time of the arrest. Also, the quicker a challenge for an arrest takes place, the more likely the matter will be resolved without the need for trial. When retained by you after a DUI arrest, I will take quick action and explore every option to mitigate or eliminate as many consequences as possible.
